When Importing MDF Products from China, do I need to Get the Product Tested Before Importing, or Does the Manufacturer Supply a Certificate of Compliance?

As an importer of regulated composite wood products, you should ensure that you only purchase compliant wood commodities.

You must demonstrate that you have taken reasonable precautions by obtaining bills of lading, invoices, or other comparable documents that include the written statement from the supplier or producer of the composite wood products, that the goods are compliant with TSCA Title VI or CARB ATCM Phase II emission standards.

One description per invoice, bill of lading, or comparable document would be sufficient to adhere to the requirements, assuming that statement would be true for all composite wood products on the document.

Panel producers or downstream entities may choose to note which products they are certifying on each document if it will promote transparency for downstream individuals.

In addition, you must have the ability to make records available within 30 days (and maintain them for 3 years) identifying the:

1. Panel producer
2. Dates the products were produced
3. Supplier (if this is a different company)
4. Date the products were purchased
