USTR: SECTION 301 MODIFICATIONS DETERMINATION FURTHER DELAYEDÂ
On July 30, 2024, the United States Trade Representative (USTR) office announced that it continues to work on finalizing the determination, with plans to make it public in the coming days. This announcement marks another delay in the final decision on proposed Section 301 modifications. The USTR had previously postponed the final determination in July to allow for a thorough review of all public commentary received in response to the proposal. Once finalized, the USTR will implement the Section 301 modifications approximately two weeks after the public release of the final determination.
PROPOSED SECTION 301 MODIFICATIONS
On May 28, 2024, the United States Trade Representative (USTR) proposed modifications to the actions under the Section 301 investigation concerning China’s acts, policies, and practices related to technology transfer, intellectual property, and innovation.Â
Section 301 exclusions were first implemented during the Trump Administration and reinstated by the Biden Administration. These exclusions, granted by the U.S. Trade Representative (USTR), came in response to petitions from American businesses and stakeholders who stated the tariffs were causing economic harm or that alternative sources for the affected products were unavailable.Â
The proposed exclusions cover a range of products across different categories and materials, including various medical equipment, plastic products, textile materials, and electronic components. These exclusions include thermoplastic masks, electric motors, printed film, medical devices, textile products, and more.
