PROPOSED SECTION 301 MODIFICATIONS
On May 28, 2024, the United States Trade Representative (USTR) proposed modifications to the actions under the Section 301 investigation concerning China’s acts, policies, and practices related to technology transfer, intellectual property, and innovation.
Section 301 exclusions were first implemented during the Trump Administration and reinstated by the Biden Administration. These exclusions, granted by the U.S. Trade Representative (USTR), came in response to petitions from American businesses and stakeholders who stated the tariffs were causing economic harm or that alternative sources for the affected products were unavailable.
The proposed exclusions cover a range of products across different categories and materials, including various medical equipment, plastic products, textile materials, and electronic components. These exclusions include thermoplastic masks, electric motors, printed film, medical devices, textile products, and more.
FINAL DETERMINATION DELAYED
The proposed Section 301 modifications prompted over 1,100 public comments that the USTR is reviewing in collaboration with the Section 301 Committee. The USTR announced this week that the final determination is delayed to complete the review of all public commentary. A final determination is anticipated in August 2024. The proposed modifications will be implemented approximately two weeks following the public release of the USTR’s final determination.
