U.S. Customs Border Protection (CBP) approved the extension of Immediate Delivery (ID) procedures for merchandise being transported between December 16 and December 31, 2022. ID privileges were first provided to importers in 2020, allowing certain merchandise (identified in 19 CFR 142.21) to be released under a special permit, which would then be considered approved for ID unless notified otherwise by the CBP.
IMMEDIATE DELIVERY PROCEDURES
Merchandise may be released under a special permit for ID in specific instances identified in 19 CFR 142.21 such as importation of (a) goods from contiguous countries (specifically Canada and Mexico); (b) fresh fruits and vegetables; (c) importation by U.S. government agencies; (d) articles of a trade fair; (e) goods subject to quota; (f) goods released from warehouse followed by a warehouse withdrawal for consumption; (g) split shipments; (h) entities shipped unassembled or disassembled on multiple conveyances; and (i) end of year authorization issued by U.S. Customs and Border Protection (CBP) Headquarters. This guidance addresses requests for ID privileges that fall within the categories identified in 19 CFR 142.21(a) through (h).
CSMS #45160485 – Update: Interim Guidance – Immediate Delivery Procedures
The reiteration of the original ID authorization is offered to importers electing for the interim Harmonized Tariff Schedule changes that take effect on January 1, 2023. However, it does not apply to absolute quote merchandise. Tariff rate quota merchandise that has previously been authorized is eligible if the entry summary is submitted within the quota period or the time specified, depending on which time frame expires first.
CBP IMMEDIATE DELIVERY FILING
Automated Broker Interface (ABI) entries will use the estimated delivery date in the AE transmissions which will identify the merchandise as from “Entry” to “Immediate Delivery”. All stakeholders are required to submit follow up documentation of ID procedures through the Document Image System (DIS). This authorization only extends to shipments transported in the December 16 – December 31, 2022 time frame.
